AI patent drafting for in-house IP teams

From invention disclosure to first draft in-house

Structure what inventors send you, triage the prior art, and hand outside counsel a first draft instead of a raw disclosure. Every step has a fixed credit cost, so the budget is predictable.

1

Disclosure to structured form

Upload the inventor's write-up, a research paper or a design report. The AI fills the invention disclosure form: field, problem, solution, key features, embodiments. The IP team corrects it once, and that record feeds everything after.

2

Prior-art triage

Run free searches across USPTO, EPO and IP India records, or a patentability search report (beta) that scores each hit for coverage of the disclosure's key features. Use it to decide file, hold or drop before paying for outside work.

3

First draft

Generate claims, then the full specification and abstract in USPTO, EPO, DPMA or IP India format. Export as .docx.

4

Hand-off to counsel

Send outside counsel a corrected disclosure, the search report and a first draft, so their time goes on claim strategy and review rather than on assembling a document.

The disclosure is where quality is won or lost

Inventors write disclosures the way they write lab notes: the clever part buried on page six, alternatives mentioned in passing, no statement of the problem. Outside counsel then spends the first billable hours reconstructing what the invention is. PatentAssist reads the material the inventor actually produced, whether a PDF, a paper or a design report, and fills a structured disclosure form from it. The IP team reviews that form, adds what is missing, and from then on the claims, the specification and the search all work from the same corrected record.

Triage prior art before outside counsel is engaged

Not every disclosure should become an application. A quick look at the closest prior art lets the review committee drop weak ideas, narrow others, and send counsel only the ones worth filing. PatentAssist gives you two levels:

  • Free search across USPTO, EPO and IP India records at search.patentassist.ai, with AI or classic field search. No account needed.
  • Patentability search report (beta, 3 credits) inside the app: an agent extracts the disclosure's key features, searches the three offices and scores each hit for coverage. The report is editable and exports as .docx.

Neither is a freedom-to-operate or validity opinion. They are a way to rank disclosures and brief counsel with the references already on the table. More on prior art search.

What each step costs

Every AI action spends a fixed number of credits, so a month's spend follows the work done. Lite gives 300 credits a month for $29 and Pro gives 1,500 for $90, both with the same features.

Credit cost of each AI action in PatentAssist
Action Credits
Patent search 1 per search
AI patent search 3 per search
Patentability search report 3
Autofill invention disclosure 10
Brief description of drawings 2
Provisional draft 6
Claims 6
Complete specification 6
Drawing figure plan 2
Patent drawing 5 per drawing
AI copilot 5 per message

Worked example: one disclosure, one pass

  • Autofill invention disclosure 10
  • Patentability search report 3
  • Claims 6
  • Complete specification 6
  • Brief description of drawings 2
  • Total 27 credits

That is one run of each step with no regenerations, copilot messages or drawings. Real drafts take more iterations, which is why the app quotes Lite at about 3 complete patent applications a month and Pro at about 15 complete patent applications a month. Heavy months can be covered with top-up packs from 100 credits for $15.

Departments with several users can ask for an Enterprise quote with credits agreed for the team. See pricing.

Keep unfiled inventions confidential

At the EPO, anything made available to the public before the filing date is prior art (Article 54(2) EPC). The US has a one-year grace period for the inventor's own disclosures (35 U.S.C. 102(b)(1)), but Europe does not, so a leak before filing can cost the European rights. That is why where disclosure content goes matters.

PatentAssist never trains AI on customer content, runs AI on Azure OpenAI in Sweden Central and Italy North, hosts the app and database in Azure Central India, and covers every account with an Article 28 GDPR data processing agreement. Your company stays the controller of inventor data. Details, including the full provider list and the foreign filing license point for US-made inventions, are on the security page.

Questions from in-house teams

Can an in-house team use PatentAssist without outside counsel?

An in-house team with registered patent attorneys or agents can draft and file its own applications, and PatentAssist produces drafts for them to review. Teams without a registered practitioner should still have one review and file. The draft is a starting point, not a finished application.

Does a patentability search report replace a professional search?

No. It is a triage tool: it extracts the key technical features of the disclosure, searches USPTO, EPO and IP India records and scores each result for feature coverage. It is in beta. Use it to rank disclosures and brief counsel, not as a freedom-to-operate or validity opinion.

How do we control spend?

Every AI action has a fixed credit cost, shown in the app and on the pricing page. Lite gives 300 credits a month for $29; Pro gives 1,500 for $90. Top-up packs start at 100 credits for $15, need an active subscription and stay valid 12 months. Enterprise credits are agreed in a quote.

Who is the controller of inventor personal data?

Your company is the controller of the personal data in the disclosures it uploads, such as inventor names and addresses, and PatentAssist acts as processor under an Article 28 GDPR data processing agreement. Sub-processors and their regions are listed publicly.

Are our invention disclosures used to train AI?

No. Disclosures and drafts are never used to train any model, ours or the provider's. AI runs on Azure OpenAI in Sweden Central and Italy North; the app and database are hosted in Azure Central India.

Can we get one account for the whole IP department?

Each user has an individual account and their drafts are scoped to that account. Departments with several users should ask for an Enterprise quote, which covers team credits, drafting workflows built to your requirements, dashboards and analytics.
