Form 18: request for examination in India

An Indian patent application is not examined until someone files a request for examination on Form 18. Without it there is no examination report, no grant, and after the deadline no application at all. This guide covers the deadline, the fees, expedited examination on Form 18A, and the PCT express request.

Quick answer

  • Deadline: 31 months from the priority or filing date, whichever is earlier, for applications filed on or after 15 March 2024. Older applications keep 48 months.
  • Fee: ₹4,000 for individuals, startups, small entities and educational institutions; ₹20,000 for others, filed online.
  • If you miss it: the application is treated as withdrawn (section 11B(4)).
  • Faster route: eligible applicants can file Form 18A for expedited examination (rule 24C).

Form 18 deadline

Section 11B(1) says no application is examined unless the applicant or any other interested person requests it within the prescribed period. Rule 24B(1) sets that period. The Patents (Amendment) Rules, 2024 cut it from 48 to 31 months for applications filed from 15 March 2024, the date they came into force.

Deadline to file the request for examination in India
Application Deadline
Ordinary application filed on or after 15 March 2024 rule 24B(1)(i) 31 months from the priority date or filing date, whichever is earlier
Ordinary application filed before 15 March 2024 rule 24B(1)(vi) 48 months from the priority date or filing date, whichever is earlier
Divisional application rule 24B(1)(iv) 31 months from the filing or priority date of the first application, or 6 months from filing the divisional, whichever is later
Application under a secrecy direction rule 24B(1)(iii) 31 months from the priority or filing date, or 6 months from revocation of the direction, whichever is later
PCT national phase application, international filing date on or after 15 March 2024 s.7(1B), rules 20(4), 24B(1)(i) 31 months from the priority date, the same day as the national phase deadline

You can file Form 18 at any point before the deadline, including with the application. Examination itself starts only after publication: applications are referred to an examiner in the order the requests were filed (rule 24B(2)(i)). A request for early publication on Form 9 removes the 18-month wait for publication.

What happens if you miss the deadline

If no request for examination is filed within the period, the application is treated as withdrawn by the applicant (section 11B(4)). Rule 138, as substituted in 2024, lets the Controller extend a time limit in the rules or condone a delay by up to 6 months on a Form 4 request, at ₹10,000 / ₹50,000 a month. Whether to allow it is the Controller's decision, so do not plan on it. Check the deadline on the application status page for any application you own.

Form 18 and Form 18A fees

Official e-filing fees from Table I of the First Schedule, as substituted in 2024. The lower rate applies when every applicant is a natural person, startup, small entity or educational institution.

Request for examination fees in rupees, e-filing
Item Lower rate Others
Request for examination Form 18, entry 28(i) ₹4,000 ₹20,000
Express request, PCT national phase before 31 months Form 18, entry 28(ii) ₹5,600 ₹28,000
Expedited examination Form 18A, entry 29, online only ₹8,000 ₹60,000
Converting a filed Form 18 to expedited Form 18A, entry 30, online only ₹4,000 ₹40,000

Every other fee, from filing to renewal, is on the patent fees in India page.

Expedited examination on Form 18A

Rule 24C lets eligible applicants file Form 18A instead of Form 18, within the same deadline and only online. Under rule 24C(1) the request can be made on any of these grounds:

  • India was the International Searching Authority or International Preliminary Examining Authority for the corresponding PCT application;
  • the applicant is a startup;
  • the applicant is a small entity;
  • all applicants are natural persons and at least one of them is female;
  • the applicant is a government department, a government company, or an institution set up by statute and owned or controlled by the government;
  • the applicant is an institution wholly or substantially financed by the government;
  • the application is in a sector notified by the Central Government;
  • the applicant is eligible under an agreement between the Indian Patent Office and a foreign patent office;

A few conditions apply:

  • Unless the application is already published or a Form 9 request is on file, Form 18A must be filed with a request for early publication (rule 24C(3)).
  • A Form 18 already on file can be converted to expedited examination (rule 24C(2)).
  • If the request does not meet the rule, it is processed as an ordinary Form 18 request from the same date (rule 24C(4)).
  • The Controller can cap the number of expedited requests accepted in a year by notice in the Journal (rule 24C(13)).
  • The FER reply period is the same 6 months plus a 3-month extension, but the extension fee is higher (rule 24C(10) and (11)).

PCT national phase: the express request

The Patent Office does not start processing a PCT national phase application before 31 months from the priority date (rule 20(2) and (4)(i)). If you enter India earlier and want processing to start at once, file an express request on Form 18 under rule 20(4)(ii), at the higher fee in entry 28(ii). For international applications filed on or after 15 March 2024, the Form 18 deadline is also 31 months from priority, so an application entering India at 31 months needs its request for examination filed at entry.

Prepare for the examination report

The examiner will search for prior art against your claims. Run the same search first, free, on IP India's records.

Form 18: frequently asked questions

What is Form 18 in Indian patents?

Form 18 is the request for examination under section 11B of the Patents Act. An Indian patent application is not examined, and so cannot be granted, until the applicant or another interested person files it.

What is the deadline to file Form 18?

31 months from the priority date or the filing date, whichever is earlier, for applications filed on or after 15 March 2024 (rule 24B(1), as amended by the Patents (Amendment) Rules, 2024). Applications filed before that date keep the earlier 48-month deadline.

What happens if Form 18 is not filed in time?

Under section 11B(4) the application is treated as withdrawn by the applicant. It cannot then proceed to grant, so diarise the Form 18 deadline from the day you file.

What is the Form 18 fee?

₹4,000 for a natural person, startup, small entity or educational institution and ₹20,000 for others, when filed online. Filing on paper costs ₹4,400 or ₹22,000.

Who can request expedited examination on Form 18A?

Rule 24C(1) allows it for startups, small entities, applicants who are all natural persons with at least one female applicant, government departments and government-owned or financed bodies, applications where India was the PCT search or preliminary examination authority, notified sectors, and applications under an agreement with a foreign patent office. Form 18A can only be filed online.

Can I file Form 18 together with the application?

Yes. The request can be filed any time within the deadline, including with the application. The application is referred to an examiner only after it has been published (rule 24B(2)), so filing Form 9 for early publication as well can bring examination forward.

Can I get the Form 18 fee back?

If you withdraw the application after filing Form 18 but before the First Examination Report is issued, rule 7(4A) allows a refund on Form 29. The First Schedule sets the refund at 90% of the examination fee.
